These Terms & Conditions (“Terms”) govern your use of MyKidsArt.ae (“we”, “us”, “our”, or the “Company”), including your access to our website and any products or services purchased through it (collectively, the “Service”). “You”, “Your” (or a similar reference) refers to you as the user of MyKidsArt.ae. By accessing or using the Service, you agree to be bound by these Terms under the laws of the United Arab Emirates.
1. Legal Compliance (UAE Law)
MyKidsArt.ae is registered under DS Enterprises Gifts Trading – L.L.C., license CN-6234961, and operates in accordance with:
• UAE Federal Decree Law No. 15 of 2020 on Consumer Protection
• Cabinet Resolution No. 66 of 2023 (Executive Regulations)
• Federal Decree Law No. 14 of 2023 on Modern Technology-Based Trade (E-Commerce Law)
• Relevant provisions of the UAE Civil Transactions Law
Your statutory consumer rights under UAE law remain in effect and cannot be excluded by these Terms.
2. Eligibility
To use the Service you must:
• Be at least 18 years old, or
• Be acting with the consent and supervision of a parent or legal guardian.
By using the Service, you agree not to engage in unlawful behavior under UAE law.
3. Definitions
• Products: Goods available for purchase on MyKidsArt.ae, including books, posters, and other keepsakes.
• Services: Customization, design, artwork collection, photography, and related fulfilment services.
• Order: A request submitted by you to purchase Products or Services through MyKidsArt.ae.
• Third party sites: Websites not managed or owned by us
4. Orders & Artwork Submission
4.1 Order Timeline All orders must be completed and artwork provided within 30 days of placing the order. If
artwork is not submitted within this period, your order may be cancelled without refund, although we may offer store credit at our discretion.
4.2 Artwork Delivery Unless otherwise agreed, our team will collect artwork normally within 7 days of ordering. If collection is delayed due to your scheduling, you may be required to deliver artwork to us directly.
4.3 Artwork Handling Your submitted artwork may be edited or adjusted (e.g., removal of staples or attachments) to ensure high-quality results. We may recycle original artwork unless you request its return for an additional fee.
5. Pricing & Payments
• All prices are displayed in AED (United Arab Emirates Dirhams) and include VAT where applicable.
• Payment is accepted via major credit or debit cards.
• You warrant that you are authorized to use the card and that sufficient funds are available.
• Delivery charges are included for all Emirates.
6. Delivery & Risk
Delivery timelines provided at checkout are estimates only and not guaranteed. Legal ownership of Products transfers upon full payment, while risk passes upon delivery.
7. Gift Cards & Promotions
• Gift cards are redeemable on MyKidsArt.ae only and cannot be applied toward the purchase of other gift cards.
• Special offers and promotions may be subject to additional conditions and may not apply to gift card purchases.
8. Returns & Refunds
In accordance with UAE Consumer Protection Law:
• Custom and personalized products are non-returnable unless defective and damaged upon receipt.
• Defects or issues must be reported within 48 hours of delivery, and must include photos of the packaging and product.
• Remedies may include repair, replacement, or refund at our discretion.
Approved refunds will be issued to the original payment method within a reasonable timeframe. This does not affect statutory rights under UAE law.
9. Complaints & Defects
If your Product is defective or incorrect:
• Notify us in writing (e.g., email) within 48 hours of receiving the Product, providing supporting evidence.
• We aim to resolve approved complaints within 7 days, although complex issues may take longer.
10. Intellectual Property
All content on MyKidsArt.ae (text, designs, images, logos) is owned by MyKidsArt.ae or its licensors and is protected by copyright law. You may not reproduce, distribute, or commercially use any content without written permission.
Artwork you upload remains your copyright, but by providing it you grant us the right to use it for the purposes of fulfilling your order and for marketing unless you specify otherwise.
MyKidsArt.ae displays products for viewing, customization, and purchase. All products are photographed and edited in-house and produced by third-party manufacturers. We do not guarantee product suitability, availability, quantity, or quality beyond the descriptions provided at the time of purchase.
11. Photography and Editing
To capture the highest quality images of your child’s creations, MyKidsArt.ae may need to carefully remove items such as glue, tape, stickers, staples, clips, nails, string, or other attachments to properly photograph each piece. We may also separate artwork from frames, backing paper, or card where necessary. As all original artwork is recycled after processing, pieces will not be reassembled.
MyKidsArt.ae reserves the right to decline any artwork that we determine is unsuitable for production for any reason. While we aim to edit each image as closely as possible to the original, some folds or creases may remain visible. Color tones may vary slightly, and in some cases, colors may be enhanced to create a more vibrant final outcome.
12. Recycling Artwork
All submitted artwork will be responsibly recycled after processing. If you would prefer to have your child’s artwork returned, this can be arranged for an additional fee. Please note that return shipping and handling charges will apply. While we take great care in handling and storing all artwork and will make every reasonable effort to return it in the same condition in which it was received, MyKidsArt.ae cannot accept liability for any loss, damage, or deterioration that may occur during handling, storage, or transit. By requesting the return of artwork, you acknowledge and accept these conditions.
13. Third-Party Sites
Links to third-party websites are provided for convenience and do not imply endorsement. You access third-party sites at your own risk.
14. Limitation of Liability
To the fullest extent permitted under UAE law:
• MyKidsArt.ae is not liable for indirect or consequential losses.
• Our maximum liability will not exceed the amount paid for the specific Product.
Nothing in these Terms excludes liability that cannot be excluded under applicable law
15. Data Protection & Privacy
We process your personal data in accordance with applicable UAE data protection laws. Your use of the Service signals consent to our collection and use of data as described in our Privacy Policy.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates.
Disputes will first seek amicable resolution; if unresolved, they may be referred to UAE courts. Consumers may also file complaints with the UAE Ministry of Economy or other consumer protection authorities.
17. Amendments
We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
